DISTANCE SALES AGREEMENT

This Distance Sales Agreement (“Agreement”) has been concluded between the Seller whose details are provided below and the Buyer who purchases tours, activities, or services electronically through the www.alanya-tours.com website (“Website”), in accordance with the provisions of the Turkish Consumer Protection Law No. 6502 and the Regulation on Distance Contracts.

2. SUBJECT OF THE AGREEMENT

The subject of this Agreement is to define the rights and obligations of the parties regarding the provision of tours, excursions, activities, and related services (“Service”) purchased electronically by the Buyer through the Website.

3. DEFINITIONS

• Service: Refers to tours, excursions, activities, transfers, and similar tourism services offered on the Website.
• Booking: Refers to the reservation made by the Buyer according to the selected date, time, and service details.
• Buyer: Refers to the natural person purchasing a Service through the Website.
• Seller: Refers to the travel agency providing the Service and identified in this Agreement.

4. SERVICE DETAILS AND PRICE

The Buyer may review the type, scope, duration, starting point, included meals, transfers, guiding services, and other details of the Service on the relevant service page and during the payment/pre-confirmation process.

The Service fee is displayed on the payment page as a total amount in Turkish Lira (TRY). Applicable taxes and legal obligations related to each booking are clearly indicated as included in or excluded from the displayed price.

5. CONCLUSION OF THE AGREEMENT

After selecting a Service on the Website, the Buyer completes the booking/payment process by electronically approving the Preliminary Information Form and this Agreement. Clicking a button such as “I Agree”, “Complete Booking”, or a similar confirmation button shall constitute acceptance and conclusion of this Agreement.

6. PAYMENT METHODS AND SECURITY

• Payments may be made via debit card, credit card, virtual POS systems, or contracted payment service providers.
• The payment infrastructure is protected by SSL or similar encryption technologies, and card information is not stored on our systems.
• For certain Services, a “pay on the tour day” option may be available. In such cases, payment terms will be clearly stated on the relevant Service page.

7. PERFORMANCE OF THE SERVICE AND BOOKING CONDITIONS

• The Service begins on the date and time selected by the Buyer from the starting point specified on the Service page.
• For Services including hotel/accommodation transfers, the meeting point and pickup time will be stated in the booking confirmation.
• The Buyer is responsible for being present at the designated meeting point on time. Refunds may not be available in cases of lateness or no-show.
• Personal expenses not included in the program, additional food and beverages, photo/video services, and similar extras are charged separately.

8. RIGHT OF WITHDRAWAL AND ITS EXCEPTION

In accordance with Article 15/1-g of the Regulation on Distance Contracts and Consumer Protection Law No. 6502, the right of withdrawal does not apply to accommodation, transportation of goods, vehicle rental, catering, leisure, entertainment, or tourism services that must be provided on a specific date or within a specific period.

Accordingly, although there is no statutory right of withdrawal for tours, excursions, and activities scheduled for a specific date, the Seller may offer flexibility to the Buyer under its own cancellation and modification policies.

9. CANCELLATION, MODIFICATION, AND REFUND POLICY

• As a general rule, cancellation requests submitted at least 24 hours before the tour start time are eligible for a full refund.
• Cancellations made less than 24 hours before the tour start time may not be eligible for a refund or may be subject to a partial refund. Any such conditions will be explained on the relevant Service page.
• If the tour cannot be operated due to weather conditions, technical issues, insufficient participation, or decisions of official authorities, the Seller may:
  • Provide a full refund to the Buyer; or
  • Reschedule the tour to another date with the Buyer's approval.
• Refunds will be processed using the original payment method. Processing times of banks and payment institutions are beyond the Seller’s control.

10. FORCE MAJEURE

The performance of the Service may become temporarily or permanently impossible due to circumstances beyond the control of the parties, including natural disasters, war, terrorism, epidemics, strikes, decisions of public authorities, or transportation disruptions. In such cases, the parties will seek reasonable solutions in good faith, and the Buyer may be offered a refund or alternative date without additional charges.

11. PERSONAL DATA AND PRIVACY

The Buyer's personal data will be processed for the purpose of providing the Service, completing the booking, and fulfilling legal obligations. Detailed information regarding the protection of personal data can be found on the Privacy and Security Policy page.

12. EVIDENCE AGREEMENT AND DISPUTE RESOLUTION

In any dispute arising from this Agreement, the electronic records of both the Seller and the Buyer (including e-mail correspondence, booking records, system logs, etc.) shall constitute conclusive evidence.

The Buyer, acting as a consumer, may apply to the Consumer Arbitration Committees or Consumer Courts located either in the Buyer's place of residence or at the Seller's location. Jurisdiction and monetary limits shall be determined according to the applicable legislation.

13. EFFECTIVE DATE

The Buyer declares that he/she has read, understood, and electronically approved this Agreement and the Preliminary Information Form before completing the booking and payment process on the Website.

This Agreement enters into force on the date it is electronically approved by the Buyer.
